CALIFORNIA HAS (3) THREE TYPES OF DISSOLUTIONS OF MARRIAGE
1- Under (5) Years of Marriage
A Dissolution is available to parties who have been married less than ( 5 ) Five Years, have no minor children, and no community property or obligations, a maximum of $ 32,000 of Separate property and no Spousal support requested by either party. Both parties must sign all required documents. A Court appearance is not necessary for this type of Dissolution.
2- Non Contested Regular Dissolutions for parties married over ( 5 ) Five Years , have no minor children / no community property or obligations.
OR
Have minor children or Community Property or Obligations, and Both Parties are in complete agreement to sign all necessary Marital Agreements and Stipulated Judgment Documents. A Court appearance is not necessary for these types of Dissolutions.
3- Contested Regular Dissolutions This is for when the parties can't reach total agreement on all issues of their case. A Court appearance may be necessary. OR, We can provide to you with a Proposed Marital Agreement that you can present to your spouse. He/She can either sign it or discuss modification that you both can agree to. If your spouse agrees to sign it or both of you can come to an agreement on modification, We can redo the agreement. Then a Court appearance Will probably not be necessary. Each time We prepare a Marital Agreement there is a $ 50 preparation fee in addition to the Divorce Document preparation fee.
